TERMS & CONDITIONS
Baby-Chella wishes to ensure that your needs are met in every way. To ensure a seamless and enjoyable experience in organising your baby shower and to facilitate a smooth and enjoyable collaboration with our Clients, we wish to highlight the following conditions and we ask that you read them carefully:
Validation
The initial quote provided after the consultation call can be adjusted if needed before we proceed further. Please note that this quote is not final and serves as a preliminary estimate to give you an idea of the costs involved based on your desires and expectations. It may vary slightly, depending on the decisions we make later on as we delve into the details of preparing the baby shower. Factors such as changes in the number of guests, additions or removals of add-ons, and adjustments to the setup size may affect the final quote. - If you have a maximum budget to respect, we will tailor our work to ensure that we stay within that budget.
Once we agree on this initial quote and budget, and confirm a date, we will then ask you to sign our Terms & Conditions document to acknowledge your understanding.
Ordering, Acceptance and Payment
The Client must pay a 33% non-refundable deposit (based on the initial quote) to secure and confirm the booking, authorising Baby-Chella to proceed with the planning and organisation of the baby shower. Once we receive the deposit, we can secure any third-party suppliers, start planning and ordering your baby shower decorations. This 33% deposit is non-refundable once Baby-Chella has already committed time and expenses to planning your baby shower.
The final quote will be sent 10 working days prior to the baby shower. We will add or remove any fees incurred due to preparations and changes made since the initial quote.
Full payment must be made by the client to Baby-Chella no later than 7 working days before the event. The remaining balance includes the outstanding amount from the initial quote and any additional fees added to the final quote. If the final quote is lower than the initial quote, the difference between the deposit and the final quote will need to be paid.
Baby-Chella will not start the setup or deliver possession of the equipment to the Client until payment funds are cleared. Payments are accepted via bank transfer or cash.
The prices displayed on our website do not include GST.
Cancellations
It is essential for Clients to be aware that all cancellations, regardless of the reason, are subject to the stipulated cancellation policy.
A cancellation of an order up to 14 working days prior to the event incurs a non-refundable fee of 50% of the order cost, along with any applicable special purpose costs.
A cancellation of an order less than 7 working days prior to the event incurs a non-refundable fee of 100% of the order cost.
Weather
Baby-Chella maintains a stringent weather policy and will refrain from setting up outdoors in the event of predicted rain during the scheduled time or if the ground is excessively wet due to inclement weather leading up to the event. Additionally, extreme heat and hazardous winds are conditions under which Baby-Chella reserves the right to decline outdoor setup.
Recognising the unpredictability of weather, if unfavorable weather conditions persist one week before the event, Clients have the option to reschedule without incurring additional costs, provided the change is agreed upon by both parties and communicated to Baby-Chella. We will of course adapt the setup to the new location, and a review of the decorations and therefore the budget can be discussed if needed.
If the Client decides not to reschedule and to cancel the event due to bad weather, the cancellation terms still apply.
To mitigate potential issues arising from poor weather conditions, Clients are strongly advised to always have a backup venue in place or make necessary provisions.
Bond
If requested by Baby-Chella, the Client must pay (in addition to the deposit) a bond equivalent to 30% of the total cost. Baby-Chella may apply as much of the bond as is necessary to compensate for any breach of contract by the Client, or any damage or loss sustained in respect of the equipment. The balance, if any, is refundable to the Client after Baby-Chella has completed the pack-down and conducted an inventory of all items.
Special Purpose Costs
If items are required to be specially produced for the event, Baby-Chella reserves the right to collect partial or full payment of these special items prior to the commencement of production.
Quotes, Variations & Amendments
Baby-Chella provides an obligation-free quotation service for the initial consultation at no cost to the client.
Please note that this initial quote is not the final quote and serves as a preliminary estimate, to give you an idea of the costs involved. Factors such as changes in the number of guests, additions or removals of add-ons, and adjustments to the setup size may affect the final quote.
Any changes to the design or setup, or requests for additional design services, can be refused if made less than 10 working days before the event. The final quote will be sent to the client by Baby-Chella 10 working days prior to the event, and full payment must be made by the client to Baby-Chella no later than 7 working days before the event.
If you wish to make changes within 10 days before the baby shower, Baby Chella reserves the right to accept or decline them. If any additions are requested and accepted, they will be charged separately on a new quote and must be paid within 48 hours.
Damage & Loss
The Client shall be responsible for any loss or damage to any of the hired items from the time Baby-Chella begins setting up the decorations until Baby-Chella packs down and retrieves everything. The Client agrees to pay the full replacement costs for any equipment lost, stolen, or deemed irreparably damaged by Baby-Chella. Such payment shall be made by the Client within 7 working days of Baby-Chella becoming aware of such loss or damage.
Setup & Pack Down
Baby-Chella will handle both setup and pack down, unless otherwise specified or agreed upon. Each event is unique, considering factors such as location and timing. Therefore, setup and pack down conditions will be specific to each event and should be discussed between the client and Baby-Chella. The setup duration varies based on the event's size and the amount of work involved.
For larger setups, preparations may sometimes need to start the day before (this does not apply to events held in public outdoor spaces, of course).
We do not impose a time limit for your event, within the constraints of a single-day event. Our pricing remains the same whether your event lasts a couple of hours or a full day. We just need to plan the setup and pack-down accordingly in advance.
Decoration Use and Return
After the baby shower, the only decorative items you may keep are the signages that were specifically made for you. Everything else belongs to Baby-Chella and is for rental only, unless prior arrangements have been made and you have paid the net price for any purchased decorations.
The client agree to be responsible for all loss or damage caused to any person or property in relation to the event.
The hired items cannot be sub-hired to other parties.
Venue (if applicable)
All venue rental fees are your responsibility and must be paid directly by you. We do not take responsibility for making venue reservations.
Access to the loading dock, lift and venue space, must be available and safe, at the times agreed, between the Client and Baby-Chella for all bump in and out requirements. Any delays, blockages or unsafe working environments will incur an additional fee deemed appropriate by Baby-Chella.
Photo Usage Agreement
When photos are taken at your baby shower by us or our designated photographer, both Baby-Chella and the client will sign a photo usage agreement. This agreement outlines the terms under which the photos may be used by Baby-Chella for marketing, promotional, and portfolio purposes. The document ensures that both parties are aware of and consent to the intended use of the images. This agreement protects the client's privacy while allowing Baby Chella to showcase its work. Copyright
The Client acknowledges that the copyright for all designs, drawings, proposals, and other materials produced by Baby-Chella or any of its collaborators in connection with this Contract remains the property of Baby-Chella (or its collaborators, as applicable). The Client must not infringe on the copyright.
The Client Agrees to review all terms and conditions before committing to Baby-Chella and to sign these clauses at the time of booking confirmation. The full document with all these terms and conditions is available here.
